Samsung está perto de vencer processo contra Apple na Alemanha

Uma corte alemã rejeitou, em um parecer preliminar, a alegação da Apple de que o tablet Galaxy Tab, já remodelado pela Samsung Electronics, ainda parece uma cópia do Ipad.

A Apple está brigando judicialmente com várias fabricantes de smartphones e tablets em cortes ao redor do mundo por motivos de propriedade intelectual.

A briga contra a Samsung, que, além de concorrente, é fornecedora da Apple, tem sido especialmente amarga, com 30 processos em dez países.

"De acordo com a avaliação da corte, o réu se distanciou suficientemente do design legalmente protegido", declarou a juíza Johanna Brueckner-Hofmann nesta quinta-feira.

Segundo ela, a decisão final foi programada para 9 de fevereiro.

Em resposta a uma decisão judicial a favor da Apple, a Samsung remodelou o Galaxy Tab 10.1 somente para o mercado alemão e o batizou de Galaxy Tab 10.1N.

A Apple, no entanto, também contestou essa nova versão, tentando impedir a Samsung de vender o produto no maior mercado consumidor da Europa.

No começo desta semana, a Samsung fez novas acusações contra a Apple na Alemanha relacionadas à tecnologia WCDMA para celulares 3G.

Apple nears German court rebuff in row with Samsung

A German court rejected Apple's claims that Samsung Electronics' reworked tablet PC still looks like a copycat version of the Ipad, in a preliminary assessment.

Apple is fighting several rival makers of smartphones and tablet PCs in courts worldwide over intellectual property.

Its battle with Samsung, which is Apple's supplier as well as a competitor, has been especially bitter, with some 30 legal cases in 10 countries.

"According to the court's assessment, the defendant has moved away sufficiently from the legally protected design," Judge Johanna Brueckner-Hofmann said in court on Thursday.

Brueckner-Hofmann added that a ruling was slated for February 9.

In response to an earlier court ruling in Apple's favour, Samsung had redesigned its Galaxy Tab 10.1 for the German market only and named it Galaxy Tab 10.1N.

But Apple challenged the reworked version as well, seeking an injunction that would ban Samsung from marketing the product in Europe's largest consumer market.

Samsung, for its part, earlier this week filed new claims in a separate dispute related to telecommunications standard technology with Apple for alleged patent infringements in Germany.
